The House of Representatives approved the legal framework for the electronic game industry this week. The Bill (PL) 2,796/2021, also known as the Legal Framework of Games, regulates the manufacture, import, marketing and development of games in Brazil. Now, the proposal goes to the sanction (kind of “ok”) by President Luiz Inacio Lula da Silva (PT).

Which in practice improves the business environment for employers and employees in the area, as well as reducing taxes in games. ”

THE bill Search to regulate all relevant aspects of the production of electronic games. According to the project’s text, the game industry will have incentives for the sector economy and tax renunciation.
To better understand: these incentives are similar to those provided for the cultural sector in the Rouanet Law and the Audiovisual Law. The idea is to stimulate content production by reducing taxes, such as the Industrialized Products Tax (IPI) of equipment needed for game development.
“The Legal Framework of Games fundamentally brings the expanded legal certainty, ensuring that the sector will not be in the taste of the manager’s desires to see its development tools being respected and fulfilled,” explains Márcio Filho of the Rio de Janeiro State Game Developers Association, according to Brazil agency.

In the definition of electronic games, computer programs enter, images generated from connection with the player, console games and virtual reality (RV), augmented reality (RA), mixed reality (RM) and extended or immersive reality.
The text also considers both games download (whether in video games, computers or mobile devices) and their streaming – when you can play from the cloud, without the console (for example, what Microsoft offers in the Xbox app for smart TVs).
Important caveat: No games of games are the games of electronic bad luck, Bet bets, online poker and others involving cash awards.
Approval of the Bill

In an interview with the agency, the president of the Rio de Janeiro State Game Developers Association (Ring), Márcio Filho, pointed out that one of the most important points of the approval of Marco Legal is precisely the construction of a legal certainty environment for the sector in Brazil.
“We are moving towards correction of historical delays – such as the absence of formal recognition of companies and games of gaming – as well as advancing on issues expensive to today’s society, such as protecting children and adolescents in virtual environment and forms of promoting and encouraging creative economy and the construction of the national soft power,” said the president of Ring.
PL 2,796/2021 will also regulate the activities of technology professionals. Everyone involved in the development of electronic games will be included in individual micro -entrepreneur categories (MEI) and the Brazilian Classification of Occupations (CBO) of the Ministry of Labor and Employment (MTE). Both portray the reality of the professions of the Brazilian labor market.
